License Journey: Terms of Service

These Terms of Service ("Terms") govern your use of LicenseJourney.com and all related services (collectively, the "Service") operated by Based Apps and Games, LLC, a Delaware LLC ("BAG," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

Plain English: By using License Journey, you agree to these rules. If you don't agree, please don't use the app.

By creating an account or otherwise accessing or using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Plain English: License Journey helps you track your hours and requirements for professional licensure. We provide tools — it's your responsibility to verify accuracy with your licensing board.

License Journey is a software-as-a-service platform designed to help licensed professionals and trainees track supervision hours, generate documentation, and monitor progress toward licensure requirements. The Service is provided for informational and organizational purposes only and does not constitute legal, professional, or licensing advice. You are solely responsible for verifying that your hours and documentation meet the requirements of your applicable licensing board.

3. Your Account

Plain English: You are responsible for keeping your account secure and for everything that happens under your account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@licensejourney.com if you believe your account has been compromised. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Subscriptions and Payment

Plain English: Paid plans are billed on a recurring basis. You authorize us to charge your payment method automatically each billing period until you cancel.

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. By providing a payment method, you authorize us to charge that payment method for all applicable fees. All fees are in U.S. dollars and are exclusive of any taxes, which are your responsibility.

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice before any price change takes effect. Your continued use of the Service after a price change constitutes your acceptance of the new pricing.

5. No Refund Policy

Plain English: All purchases are final. We do not offer refunds for any subscription fees, whether partial or full, including if you cancel mid-period or stop using the Service.

All fees paid to License Journey are non-refundable. This includes, without limitation:

Monthly or annual subscription fees, paid in advance;
Any unused portion of a subscription period remaining after cancellation;
Charges incurred due to failure to cancel before a renewal date;
Charges for accounts suspended or terminated due to a violation of these Terms.

You may cancel your subscription at any time, and you will retain access to paid features through the end of your current billing period. Cancellation takes effect at the end of the then-current billing period; no partial-period refunds will be issued.

If you believe a charge was made in error, please contact us within 30 days of the charge at support@licensejourney.com. We will investigate and, if an error is confirmed, issue a correction at our sole discretion.

6. Cancellation

Plain English: You can cancel anytime from your account settings. Your access continues until the end of the billing period you already paid for.

You may cancel your subscription at any time by accessing your account settings or by contacting us at support@licensejourney.com. Upon cancellation, your subscription will not renew, and you will retain access to paid features through the end of your current billing period.

We reserve the right to suspend or terminate your account at any time for violations of these Terms, without notice and without liability to you.

7. Your Data

Plain English: Your data belongs to you. You give us permission to store and process it in order to run the Service. We don't sell it.

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. We will not sell your data to third parties. Our data practices are described in our Privacy Policy.

8. Acceptable Use

Plain English: Use the Service legally and honestly. Don't abuse it, hack it, or use it to do anything harmful or fraudulent.

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Submit false, misleading, or fraudulent information, particularly regarding licensure hours or supervision records;
Attempt to gain unauthorized access to any part of the Service or its infrastructure;
Interfere with or disrupt the integrity or performance of the Service;
Reverse engineer, decompile, or attempt to extract source code from the Service;
Use the Service to transmit spam, malware, or other harmful content.

9. Disclaimers

Plain English: We provide the Service as-is. We don't guarantee it will be perfect or always available, and we're not responsible if something goes wrong with your licensure process.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no representation that information in the Service is accurate, complete, or current with respect to any jurisdiction's licensure requirements. You are solely responsible for independently verifying all requirements with your applicable licensing board.

10. Limitation of Liability

Plain English: If something goes wrong, our financial liability to you is capped at what you paid us in the last 12 months. We're not liable for indirect losses like lost income or a delayed license.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAG, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR DELAYS IN OBTAINING A PROFESSIONAL LICENSE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50.

11. Governing Law

Plain English: Any disputes will be governed by Delaware law and handled in Delaware courts.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any disputes arising under these Terms.

12. Changes to These Terms

Plain English: We may update these Terms. If we make material changes, we'll let you know. Continued use after changes means you accept them.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice in the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
